All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Lorraine Keith Lkgenee@aol;com May 31, 2010, 3:40 pm Source: Northampton Co., Pa, Will Bk. 3, Pp. 122-3, Fhl Microfilm 946457 Written: March 13, 1790 Recorded: March 31, 1797 I Jacob Emerich senior, from the township of Upper Mount Bethel in Northampton County and state of Pennsylvania, miller, am old, feeble and very ill, but still of sound mind and memory (for which I thank God) do on the thirteenth day of March in the year of our Lord one thousand seven hundred seven and ninety make known this my last will and testament in, manner (?) and form (? )) as follows (?)-- seriously commend my soul into the hands of the almighty God which gave it to me and my body to the earth auf ? ? to be given a Christian burial -a hope of a joyful resurrection through the merit of my Savior Jesus Christ and of (?) the worldly goods and temporal fortune which it has pleased God to bless me, in the following way: First it is my will that my legal debts and burial be paid Secondly I bequeath of the land that I own to my eldest son Philipp one hundred acres on which the flour mill, sawmill and the house built on it which I everything ______ the flour mill and sawmill and the new ? _____ to my said son Philipp I bequeath one hundred acres of land his line shall begin at the lowest _______ and on the ____ _____ Revier go up to one of the hickory tree determined by me, from there a straight line to the bridge by the old house, and from there up the pike? to the farthest line back. Further, I give and bequeath to my second son Jacob two hundred acres of land. His line shall begin at the aforementioned hickory tree and go up the ____ _____ half way to the William Marks line, from there a straight line backwards to the back line. Further, I give and bequeath to my two sons Johannes and Joseph two hundred and fifty acres of land. Their line shall go halfway to the William Marks line (as ______) begin from there the Delaware Revier (river?) up to the William Marks line, and from there the line back to the line farthest back ___ _____ of more or fewer acres, Further, it is my will that my son Johannes have exactly the half and my son Joseph the other half of ______two hundred and fifty acres and my son Johannes should have his portion of the land under my son Jacob his from the __________ _________ on up to the farthest back line and the very best part my son Joseph thirdly from this here bequeathed land to my _____ sons Phillipp and Jacob pay yearly. Namely my son Phillip shall and must and hereby be bound to pay my daughter Magdalena the sum of three hundred pounds. I say three hundred pounds and these three hundred pounds he shall pay when my daughter Magdalena reaches her majority with valid money which is then in circulation as is the custom in Pennsylvania. And my son Jacob shall and must and is hereby bound to pay my daughter Catarina, married to Jacob Schneider (?), to her children the sum of one hundred pounds and these hundred pounds my said son Jacob pay to the ________ children _______ his part of that when they reach the age of majority. In addition I give her, namely to my daughter Catharina everything that she already (has)e from me, and this shall be her inheritance and otherwise nothing. Further my son Jacob is hereby bound to pay my daughter Sara the sum of one hundred fifty pounds in the following manner: one year after my death shall and must my son Jacob pay my daughter Sara the sum of fifty pounds, one year later again the sum of fifty pounds, and everything with valid and money which is then in circulation as is the custom in Pennsylvania. Further, my son Jacob is hereby bound to pay two hundred and fifty pounds or to spend in the following manner: namely from my daughter Sara's portion my son Jacob shall continue to pay the sum of fifty pounds every year, and these two hundred and fifty pounds shall be divided to the ____ ____ and with the same in equal parts (when all costs and debts are legally paid) among all my children with the exception of my daughter Catarina who is here excepted. Further, it is my will that my daughter Elisabeth should have of the ____ money which added to the ______ goods the sum of twenty pounds advanced, and when my daughter Anna Maria's (who is deceased) daughter Elizabetha Seigen reaches her majority, she shall also receive the sum of ten pounds. Further I bequeath to my son Jacob the house where I presently live, that is to say the _____ _____ nails and so on, that he can tear it down and build it on his own land wherever he wants to. Further it is my will that the plantation bordering on Andreas Krells Robert Reich____ and others I give to my daughters Elizabetha, Margaretha and Christina, they should divide it as they wish. They should have the choice according to their age. My executors are hereby directed to give ______ .contracts ____ ____ ____ the land. Further my two sons Philipp and Jacob are hereby bound to keep my minor daughter Magdalena with them, to clothe and treat her as a child until she has reached the age of eighteen years. They shall have her learn to read and write and to bring her up and keep her in the Lutheran religion until she receives Holy Communion. Further it is my will that my two sons Johannes and Joseph each receive a horse _________. Further it is my will that when one or the other of my children should die without heirs, his portion should be divided among the other children and I hereby ____ and ____ my son Phillip and my son Jacob and my son-in-law (?) Peter Hilgert (?) to witness this my last will and testament and overturn all previous wills ____I not at all. In addition it is my will that the ____ which not be an annoyance, four weeks after my death _____ and peacefully should be ________. Herewith I give my hand and seal the day and in the year as by the above- named Jacob Emrich Sen. Georg Reinet Jacob Additional Comments: The will, written in German, was translated from a microfilm copy by V. J. Anderson, a German instructor who was also an amateur genealogist familiar with older versions of the German script. Some of the microfilm was illegible making it nearly impossible to translate every word. The original will book should be consulted to identify the missing words.
